Cashkr Indemnity Terms and Conditions

2. Scope of Business

Cashkr specializes in the purchase of pre-owned electronic devices, including but not limited to:

  • Mobile smartphones
  • Laptops and desktops
  • Tablets and MacBooks
  • Cameras and drones
  • Televisions and air conditioners
  • Headphones and watches
  • Gaming consoles

3. Seller Declarations and Warranties

By accepting Cashkr's purchase quote for any device, the seller hereby declares and warrants:

3.1 Identity Verification

  • All personal details and identification documents provided are accurate and authentic
  • Acceptable forms of identification include:
    • Aadhar Card
    • Passport
    • Government-issued photo ID with address
  • All personal information submissions are subject toCashkr's Privacy Policy

3.2 Device Ownership

The seller confirms that:

  • They are the legitimate and rightful owner of the device
  • The device is free from all encumbrances, third-party interests, and liabilities
  • The device is not stolen property
  • They possess full legal authority to transfer device ownership
  • Cashkr bears no responsibility for any legal disputes regarding device ownership

4. Indemnification Obligations

4.1 Scope of Indemnification

The seller agrees to indemnify, defend, and hold harmless Cashkr, including its:

  • Employees
  • Directors
  • Officers
  • Agents
  • Assigns
  • Successors

4.2 Covered Claims

This indemnification covers all losses, damages, claims, liabilities, expenses, and costs (including attorney'sfees) arising from:

  • Violation of these Terms & Conditions
  • Use of Cashkr's services
  • Breaches by the seller or authorized third parties
  • Non-fulfillment of seller responsibilities
  • Violations of applicable laws and regulations, including:
    • Statutory dues and taxes
    • Privacy rights
    • Intellectual property rights
    • Defamation claims
    • Service disruption claims

4.3 Settlement Procedures

  • The seller cannot settle any claim without Cashkr'sprior written consent
  • Cashkr will make reasonable efforts to notify the seller of any claims or proceedings
  • This indemnification obligation survives termination or modification of these Terms

5. Data Protection

The seller releases Cashkr from all liability regarding:

  • Data stored within the device
  • Information contained in associated media
  • Any data-related losses or damages

6. General Provisions

6.1 Modifications

Cashkr reserves the right to modify these Terms without prior notice. Continued use of the platform constitutes acceptance of modified Terms.

6.2 Governing Law

  • These Terms are governed by Indian law
  • All disputes will be resolved in Mumbai courts
